Abandoned Computer Policy 

Computer Help NZ Ltd. aims to fix most computers within a day, and payment is due on completion of the work. We expect customers to collect their computer (even if the computer is unable to be repaired) within a day or two of being informed. If you need longer, please let us know. 

Abandoned computers are computers that are left at Computer Help NZ Ltd (hereafter referred to as CHNZ) for more than 3 months (90 days) from the date the invoice, being the time the work was completed. 

If a computer is left abandoned for more than 90 days in our workshop, CHNZ will sell the item through an auction house as a loss recovery measure to recoup the cost of labour carried out, and storage costs. 

During those 90 days CHNZ will make reasonable efforts to contact the customer by phone, txt and letter (where such methods of contact are available) as set out below. If after this time CHNZ has received no response from the customer, and it has reached the 90-day deadline,  CHNZ will dispose of the computer according to the  Contract and Commercial Law Act  (2017) https://www.legislation.govt.nz/act/public/2017/0005/latest/whole.html 

The Communications Process will be 

  1. Call or text the customer within 5 minutes of the job being completed to say it’s ready.
  2. Approximately seven days after the completion of the work, call and/or text the customer to remind them to collect their computer(s) or device(s)
  3. Thirty days (minimum) after the completion of the work, we’ll send a reminder notice via letter.
  4. Sixty days (minimum) after the account was overdue, CHNZ will send the owner of the computer(s) or device(s) final written notice of their obligation to collect and pay for the computer(s) or device(s). This notice will include notification of any monies owing for the work, plus notice of CHNZ’s intention to dispose of or sell the computer(s) or device(s) if they remain uncollected after a further 30 days from the date of the letter. 

  

The Disposal Process will be 

  1. Ninety days after the account was overdue, we will begin the process to dispose of the computer(s) or devices(s).  
  2. Notification will be made in the local newspaper of our intention to sell the computer in question by auction. We’ll list our business name, computer description, the amount owing and the date which will be 7 days from the date of the advertisement. Seven days later the computer(s) or device(s) will be wiped of personal data to protect the privacy of the customer for when it’s sold by auction. https://privacy.org.nz/responsibilities/your-obligations/
  3. Proceeds of the sale will be used to pay for the newspaper advertising, the auction fees, storage of the computer(s) or device(s) ($1 per day) and the amount owing for the work. 
  4. Any remaining money will be returned to the customer via the Registrar of the District Court nearest the place of sale, where it will be held for the customer to collect. 
  5. We’ll keep a record of the financials of this transaction.
